AllTrack Music Rights Inc. (“AllTrack”, “we”, “us” or “our”) is a United States based rights management organization that represents the rights of music creators and publishers, and grants licenses for the use of the associated musical works in its repertoire.  AllTrack is proud to play a leading role in supporting the long-term success of its many affiliates, as well as supporting the global music industry as a whole.

AllTrack knows that you care about your personal information and how it is used and shared.  An important part of AllTrack’s commitment to its affiliates, licensees, employees, and visitors (“you” or “your”) is respect for your right to privacy.  AllTrack appreciates the opportunity to provide any of its assistance and services to you and strives to the highest level of service excellence.  This means taking your privacy seriously, and being open and transparent regarding our use, disclosure, and practices regarding your personal information.

Please read the following to learn more about our privacy policy.  By visiting the AllTrack managed domains and websites, native apps or any other linked pages, features, content, or application services offered from time to time by and related to or involving AllTrack (collectively, the “Website”), submitting information, or using any of our services, you acknowledge that you accept the practices and policies outlined in this privacy policy (the “Privacy Policy”).

ALLTRACK’S COMMITMENT

This Policy applies to all of your “personally identifiable information” collected, used and disclosed by AllTrack.  “Personally identifiable information” is information about you that can identify you and is sometimes referred to as “personal data”.  For example, your social security number, your credit card information, and a picture of you are all personally identifiable information.

This Privacy Policy covers AllTrack’s treatment of information that AllTrack gathers when you are accessing our Website and when you utilize our services.  Also, this Privacy Policy covers AllTrack’s treatment of your information that our business partners share with us.  This Privacy Policy does not apply to the practices of third parties that AllTrack does not own or control (such as third-party websites that you may access from the Website), or to individuals that AllTrack does not employ or manage.

Additionally, if you are located in the EEA, we note that we are processing your personal data in order to fulfill affiliate contracts we might have with you or otherwise to pursue our legitimate interests, unless we are required by law to obtain your consent for a particular processing operation.

WHAT PERSONAL INFORMATION WE COLLECT AND WHY WE COLLECT IT

The information that AllTrack gathers enables us to establish accounts as well as personalize and improve our services.  AllTrack is committed to only collecting personal information needed for it to properly conduct its business and only collect it by fair and lawful means.

When you become an AllTrack affiliate, licensee, or employee, or visit our Websites, AllTrack collects your personal information for the following purposes:

  • ensure security, reliability, and quality of our networks, services, Website and to avoid any tampering, damage, and/or misuse of our networks, services, and
    Website;
  • administer the rights, in the United States and internationally, of our affiliates;
  • license users;
  • manage AllTrack’s repertoire of musical works;
  • set up and establish your identification;
  • respond to requests from you;
  • communicate account specific details, new features, offers and updates;
  • remember your information so that you will not have to re-enter it during your visit or the next time you visit the Website;
  • comply with tax requirements;
  • comply with legal requirements;
  • set you up as an employee;
  • protect you and AllTrack from error and fraud;
  • monitor aggregate usage metrics such as total number of visitors and pages viewed; and
  • for limited marketing purposes.

 
AllTrack may collect your voice and/or likeness when you call AllTrack or visit certain parts of AllTrack’s premises, as your call to AllTrack may be recorded and you may appear in video recordings of AllTrack’s premises.

Cookies
Like many sites, we may also place cookies on your device.  A cookie is a small text file that can be used to collect Website usage data and make improvements to the site. Through third party affiliates, like Google Analytics, we implement cookies to collect information about the device you use to browse, the operating system, the inferred location of your IP address to identify your device, your visit duration, pages visited, language preference, etc.  In addition, we place a cookie on your device when you visit the secure portion the Website.  AllTrack will retain the information collected during your visit to the secure site to enable your efficient use of the secure site or if applicable track activity for purposes of calculating credit under an affiliate program.

We strongly recommend that you leave the cookies activated, because cookies enable you to take advantage of some of our Website’s most attractive features such as recognizing your preferences for future visits to eliminate your need to re-enter information.

Information provided by you
Most personal information collected by AllTrack is voluntarily supplied by you when you sign up, request, and/or utilize any of the services that we provide to our affiliates, licensees, and/or visitors, engage as an employee, and/or engage in communications with AllTrack.  For these reasons, AllTrack collects different types of information from different types of interactions and/or parties.  Please note that you may fall under more than one of the below types of parties with whom AllTrack interacts.

From Visitors
The following personal information may be collected and used by AllTrack to communicate with you, for security reasons, quality assurance, quality improvement, and to fulfill AllTrack’s legal and legitimate business requirements:

From Employees
The following personal information may be collected and used by AllTrack to communicate with you, to comply with tax laws and regulations, for security reasons, quality assurance, quality improvement, to fulfill AllTrack’s legal and legitimate business requirements, to ensure you are properly identified as an employee of AllTrack, to administer payroll and employee benefit programs, and to be able to contact your emergency contact in case we need to notify anyone of your involvement in an emergency situation while at work:

Personal information provided by third parties
Some personal information collected by AllTrack is provided by third parties, including international collecting societies with whom AllTrack has entered agreements or by through third parties that AllTrack has entered into agreements with.  Foreign societies provide us with information related to their works and information regarding usage of AllTrack’s repertoire outside of the United States.  AllTrack may also collect personal information from external databases that it has access to.

Personal information about other individuals
If you provide us with information about other individuals (e.g. your next of kin), you confirm that you have informed the relevant individuals accordingly.

Public information
AllTrack may maintain a Public Repertoire on its Website that contains information about musical works in AllTrack’s repertoire and any foreign repertoire that AllTrack is authorized to license.  This information may include personal information of AllTrack affiliates and/or members of international collecting societies affiliated with AllTrack, including names, work identification numbers, affiliated societies and IPI numbers.

WHO WILL HAVE ACCESS TO YOUR PERSONAL INFORMATION

AllTrack is committed to a high standard of confidentiality and privacy.  AllTrack will only use and/or disclose your personal information for the reason(s) it was collected.  This means that AllTrack will share your personal information with you for the purpose of providing or improving our services, and may share specific personal information with third parties, including third parties that may be located outside of the United States, engaged to:

  • assist us in providing or improving our services such as web hosting, maintenance providers, etc.
  • process work usage and other data
  • provide cloud computing services
  • facilitate exchange of information relating to the works in which rights holders own or control and for the purposes of licensing, collection and distribution of royalties
  • facilitate exchange of information relating to benefits provided to or make available to our affiliated writers and publishers
  • process credit cards
  • provide customer service

 
These third parties are prohibited from using your personal information for any purpose other than to provide the services noted above, and they are required to protect all personal information and comply with the general privacy principles described in this Policy.

We may also share some of your personal information with our companies affiliated-related through ownership.  Further, we may release Information when we believe in good faith that release is necessary to comply with any applicable laws, rules or regulations; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of AllTrack, our employees, our users, or others.  This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

If AllTrack, or all or any portion of its business or assets, are acquired, sold, or otherwise transferred, including in any merger or other transaction, or in the unlikely event that AllTrack goes out of business or enters bankruptcy, affiliate, licensee, employee and visitor information would be one of the assets that would likely be transferred to or acquired by the successor or acquirer (or a third party through bankruptcy).  You acknowledge and agree that such transfers may occur in any of these circumstances, and that any acquirer or successor or other party acquiring all or any portion of AllTrack’s business or assets may continue to use your information as set forth in this policy.

Other than above, we will not share any of your personal information without your consent, unless there is a requirement to do so by law.

Subject to certain exceptions, such as legal or contractual restrictions, you may withdraw your consent at any time to any further collection, use, or disclosure of your personal information by contacting AllTrack as specified below.  However, you should be aware that if you withdraw your consent, AllTrack may be unable to fulfill certain services such as paying you your royalties or granting you a license, which could render you in violation of IP law if you play music from AllTrack’s repertoire.

HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION

We strive to retain your personal information for as long as it fulfills its intended purpose, or as required under and tax or legal regulation, statutes or matters.   Where we process affiliate personal data, we do this for as long as you are an affiliate and for three years after this unless there is a statutory, financial or business requirement to retain this data.

IS YOUR PERSONAL INFORMATION SECURE

Your AllTrack account Information is protected by a password for your privacy and security.  You need to protect unauthorized access to your account and information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account.  You are prohibited from sharing your exclusive AllTrack login information and if you share your password or your information with others, remember that you are responsible for all actions taken in the name of your account.  If you lost control of your password, you may lose substantial control over your information and may be subject to legally binding actions taken on your behalf.  Therefore, if your password has been compromised for any reason, you should immediately notify AllTrack and change your password.

While no data transmission over the internet or data storage system is guaranteed to be 100% secure, AllTrack has implemented security controls to protect against unauthorized use, access, alteration, duplication, destruction, disclosure, loss or theft of your personal information

AllTrack maintains physical, electronic and procedural safeguards to protect your personal information. Examples of safeguards include: restricted access to our information processing and storage areas, limited access to relevant information by authorized persons only, use of passwords, firewall technology, encryption of electronically transmitted information, antivirus software and the use of physical security measures, including secure locks on filing cabinets and doors.

AllTrack is also committed to working with you to protect the security of personal information during any transfer to AllTrack.  Additionally, AllTrack has agreements and controls in place with third party service providers requiring that any information provided to AllTrack be transmitted and safeguarded with the industry standard technological security standards in mind.

HOW YOU CAN ACCESS AND CONTROL YOUR PERSONAL INFORMATION

In the course of interacting with AllTrack, you are welcome to review or verify your personal information.  In most cases AllTrack collects your personal information directly from you.  If you discover inaccuracies in AllTrack’s data, please make the appropriate changes within your account settings or notify AllTrack to make the necessary changes.  AllTrack may need specific information from you for identify confirmation or for other purposes, to enable AllTrack to search for and provide you with the personal information AllTrack holds about you.  Please note that access to your personal information will be subject to AllTrack’s retention policy.

AllTrack will disclose to its affiliates, licensees, employees, and visitors this Policy and make information available concerning the policies and practices that apply to the management of their personal information.

The Website may contain links to other sites, including the sites of service providers that AllTrack considers potentially beneficial to the pursuit of success in the music industry.  AllTrack is not responsible for the privacy policies and/or practices on other sites.  When visiting another site you should read the privacy policy stated on that site.  This Privacy Policy only governs information collected on the Website.

CHILDREN

Consistent with the federal Children’s Online Privacy Protection Act of 1998 (“COPPA”), we will never knowingly collect personally identifiable information from anyone under the age of 13 without requiring parental consent.  Any person who provides their personal information to AllTrack through the Website represents that they are 13 years of age or older.

California Minors under 18 Years of Age
California law provides additional rights to minors under the age of 18 residing in California.  You may request the removal of any of your information you submitted while under the age of 18.  Note that AllTrack can and will remove information of individuals meeting this criteria upon request from its internal systems but cannot guarantee removal of information that you requested be provided to any systems outside of AllTrack’s control.  YOU AND YOUR PARENT OR GUARDIAN UNDERSTAND IT IS NEAR IMPOSSIBLE TO HAVE INFORMATION ENTIRELY REMOVED FROM THE INTERNET ONCE IT APPEARS.

European Union and European Economic Area
The Website is not intended for children accessing the Website from the European Union or the European Economic Area who are under the age of 16.

CHANGES TO THIS PRIVACY POLICY

AllTrack may update this Policy from time to time.  The most current version of the policy will govern our use of your Information and will be available on https://www.alltrack.com / www.alltrack.com.  We will alert you by posting a notice on our Website when changes are made or if, in our sole discretion, the change is material to you, we will send an e-mail to the email address associated with your account with information about the change.  We encourage you to periodically check for the latest information on our Policy.  You are bound by any changes to the Privacy Policy when you use the Website after such changes have been first posted.  By providing your personal data to AllTrack through the Website, you consent to the use of your personal data for the uses identified above in accordance with the Privacy Policy.
